1. Introduction

These Rental Terms and Conditions (“Terms”) govern the rental of equipment (“Equipment”) by you (“Customer”) from Katlisto Trading (“Lessor”). By renting Equipment from Lessor, you agree to be bound by these Terms. Please read these Terms carefully before placing an order.

2. Equipment Availability and Reservation

• Equipment availability is subject to prior confirmation by Lessor.
• Customer can reserve Equipment by contacting Lessor and providing necessary details about the rental period, desired delivery and pickup dates, and chosen wet/dry rate option.
• A confirmed reservation constitutes a binding agreement between Lessor and Customer, subject to these Terms.

3. Rental Rates and Payment

• Rental rates are based on the chosen equipment, rental period (weekly, monthly, or yearly), and wet/dry rate option.
  
  • Wet rate: Includes the equipment, operator, fuel, and basic insurance.
  • Dry rate: Includes the equipment only. Customer is responsible for the operator, fuel, and insurance.
• Specific rental rates will be provided to the Customer upon request or during the reservation process.
• Payment for the rental period is due in full upon equipment delivery, unless otherwise agreed upon by Lessor in writing.
• Customer is responsible for all applicable taxes and fees associated with the rental.

4. Delivery and Pickup

• Lessor offers delivery and pickup services for a fee, based on the location, distance, and size of the equipment. Specific fees will be quoted upon request.
• Customer is responsible for ensuring the delivery and pickup locations are accessible for the equipment and meeting any necessary permits or requirements.
• Customer is responsible for inspecting the Equipment upon delivery and noting any existing damage on the delivery receipt.

5. Use of Equipment

• Customer shall use the Equipment in a safe, responsible, and lawful manner, complying with all applicable laws and regulations.
• Customer shall only operate the Equipment through qualified personnel with the necessary training and experience.
• Customer shall not use the Equipment for any purpose other than its intended use.
• Customer is responsible for all fuel, lubricants, and other consumables used during the rental period (applicable only with dry rate option).
• Customer shall maintain the Equipment in good working order and report any malfunction or damage immediately to Lessor.

6. Damage and Loss

• Customer is liable for any loss or damage to the Equipment occurring during the rental period, regardless of cause.
• This includes damage caused by Customer’s negligence, misuse, unauthorized operation, or failure to properly maintain the Equipment.
• Customer is responsible for the cost of repair or replacement of the Equipment at fair market value, as determined by Lessor, in case of loss or irreparable damage.

7. Insurance

• Lessor provides basic insurance coverage with the wet rate option.
• Customer is responsible for obtaining additional insurance coverage for the Equipment, if desired, under the dry rate option.
• Customer shall provide Lessor with a certificate of insurance naming Lessor as an additionally insured party, if required by Lessor.

8. Termination

• Lessor reserves the right to terminate the rental agreement and repossess the Equipment at any time, without notice, if Customer breaches any of these Terms.
• Customer shall be liable for all rental fees accrued up to the date of termination, as well as any damages to the Equipment and costs associated with its repossession.

9. Limitation of Liability

• Lessor shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the rental of the Equipment, even if Lessor has been advised of the possibility of such damages.
• Lessor’s liability under these Terms shall be limited to the amount of the rental fee paid by Customer.

10. Dispute Resolution

• Any dispute arising out of or related to these Terms shall be governed by and construed in accordance with the laws of [Your Country/State].
• Any dispute arising out of or related to these Terms shall be submitted to the exclusive jurisdiction of the courts located in [Your City/State].

11. Entire Agreement

These Terms constitute the entire agreement between Lessor and Customer regarding the rental of the Equipment and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

12. Amendment

These Terms may be amended by Lessor at any time by posting the amended terms on its website or by providing written notice to Customer.
